Abstract

This article examines issues related to the lease agreement in socio-legal relations in Islamic law.

An important aspect of the study of this topic is that along with the regulation of socio-legal relations between people, it will be a solution to today's pressing problems in the field.

In the scientific article, the lexical meaning of the word "rent" was discussed on the basis of information provided in dictionaries, encyclopedias and other sources. Not only the opinions of the mujtahids of the Hanafi school, but also the opinions of the faqihs of other schools of the Ahl as-Sunnah wa'l-Jama'ah on its scientific and terminological meaning have been scientifically studied and compared.

There is also evidence of the legality of the lease agreement, including verses from the Qur'an, hadiths, and the opinions of commentators and hadith scholars on them. At the same time, the opinions of scholars who claim that the lease agreement is not permissible in the Shari'ah and their arguments are stated, their views were studied in detail, compared, and rebuttals were made

Purpose. The analysis of information related to lease agreements in sources related to Islamic law consists of scientifically substantiating its legal basis.

Methods. Methods such as complex approach, systematic, historical, comparative-critical, source studies, as well as general research methods were widely used in the coverage of the topic.

Results. Information on the lexical meaning of the lease from dictionaries, encyclopedias and jurisprudential sources was studied, analyzed and scientific conclusions were made. Thus, the word rent in the dictionary means "salary given for any action".

The scientific and terminological meaning of the lease has been studied and comparatively analyzed not only on the basis of fiqh sources belonging to the Hanafi school, but also on the basis of fiqh sources belonging to other sects of the Ahl as-Sunnah wa'l-Jama'ah. So, its scientific-terminological meaning: it determines whether a person should give something for a certain period of time for using along with the compensation.

The article also focuses on the issue of productiveness, even though the lease agreement is fixed in the Shari'a on the basis of verses from the Qur'an, hadiths, and the consensus of the ummah (union of scholars). It should be noted that the Hanafi jurists widely used the method of productiveness in solving problems related to social relations.
